China Cosmetics Responsible Person

Foreign brands seeking to sell cosmetics products in the Chinese market must appoint a Cosmetics Responsible Person, officially referred to as a Domestic Responsible Agent or DRA, under the Cosmetic Supervision and Administration Regulation (CSAR). This legal requirement is enforced by the National Medical Products Administration (NMPA), which oversees both general (ordinary) cosmetics and special cosmetics. Without a designated responsible person, no foreign brand can proceed with cosmetic registration and filing in the Chinese market.

Choosing your form of legal representation in China is a crucial first step. Foreign cosmetics registrants, whether manufacturers or brand owners, must appoint a domestic responsible person for each product. The responsible person must be a legally established entity in China with a business license that covers cosmetics and new cosmetic sales. The NMPA permits cosmetics applicants to appoint multiple Domestic Responsible Agents, and in theory, a different DRA may be designated for each product. The DRA function is expanding as regulatory focus shifts from point-in-time approval to whole lifecycle supervision and inspection work.

The responsible person is accountable for the entire product lifecycle. This includes:

Label drafting in line with mandatory national standards
Submission of registration and filing applications for general cosmetics, special cosmetics, and new cosmetic raw materials
Sample import coordination and product testing
Handling of ingredient code applications for existing cosmetic ingredients as listed in the Inventory of Existing Cosmetic Ingredients in China (IECIC)
Post-market adverse reactions monitoring, including cosmetics adverse reactions and recall coordination
Compliance with technical standards and market regulation
Submission of annual reports and maintaining regulatory communication.

The domestic responsible person also assists facilitates responses to enquiries from the NMPA and local MPA supervision departments, and ensures compliance with all regulatory requirements and administrative regulations.
